By opting in to receive SMS messages from STAYBOOKED ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not opt-in to our messaging service.

2. Description of Service

STAYBOOKED provides automated SMS messaging services for appointment reminders, rescheduling confirmations, service updates, and review requests. Our service is designed to help businesses reduce no-shows and improve customer communication.

3. User Responsibilities

By using our service, you agree to:

• • Not attempt to circumvent or interfere with our service

4. Message Charges and Billing

Standard message and data rates may apply to SMS messages sent to your mobile device. Charges are determined by your mobile carrier and are not controlled by STAYBOOKED. We are not responsible for any charges incurred from receiving our messages.

Message frequency varies based on your appointment schedule. You may receive 0-4 messages per month, depending on your booking activity.

5. Opt-Out Procedures

You may opt-out of receiving SMS messages at any time using any of the following methods:

• • Reply "UNSUBSCRIBE" to any message

• • Email us at hello@staybooked.online with "SMS Opt-Out" in the subject

After opting out, you may receive one final confirmation message. Opt-out requests are processed within 24 hours of receipt.

6. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice. We may also update these Terms from time to time.

7. Limitation of Liability

To the maximum extent permitted by law, STAYBOOKED shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our SMS service, including but not limited to:

• • Service interruptions or delays
• • Mobile carrier issues or network problems
• • Any damages resulting from reliance on our messages

Our total liability shall not exceed the amount paid for the service in the 12 months preceding the claim.

8. Compliance with Laws

This service complies with the Telephone Consumer Protection Act (TCPA) and other applicable federal and state laws. By opting in, you consent to receive automated messages as described in our opt-in process.

We maintain records of consent and opt-out requests as required by law and regulatory guidelines.

9. Intellectual Property

All content, trademarks, and intellectual property rights in our service are owned by STAYBOOKED or our licensors. You may not use, copy, or distribute any content without our express written permission.

10. Indemnification

You agree to indemnify and hold harmless STAYBOOKED from any claims, damages, or expenses arising from your use of our service or violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the use of our service shall be resolved in the courts of Los Angeles County, California.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and STAYBOOKED regarding the use of our SMS service.
